TRANSPORT WAIVER
PATIENT AND CARER TERMS OF USE, WAIVER AND RELEASE
IMPORTANT NOTICE: PLEASE READ THESE TERMS OF USE CAREFULLY
These Terms of Use govern your use of the services provided by Fly2 Foundation ("Fly2 Foundation", "we", "us" or "our") and constitute a legally binding agreement between you (the "Patient" and the "Patient's Carer" collectively referred to as "you" or "your") and Fly2 Foundation. By accepting these Terms of Use, you acknowledge and agree to be bound by all provisions herein.
1. Definitions
In these Terms of Use:
Claim means any claim, loss, liability, damage, proceeding, order, judgment, costs (including legal costs on a full indemnity basis), or expense;
Flight Request Form means the form submitted by the Referrer to Fly2 Foundation requesting our services;
Patient means the individual requiring transport services and medical treatment, not onboard the aircraft;
Patient's Carer or Carer means the individual(s) accompanying the Patient during receipt of our services, including parents, guardians, family members, or support persons;
Referrer means any medical or allied health professional referring the Patient to Fly2 Foundation;
Representative of a party includes an employee, agent, officer, director, auditor, adviser, partner, consultant, contractor, or subcontractor of that party;
Services means the services provided by Fly2 Foundation for the benefit of the Patient, including ground and air transport services to facilitate attendance at specialized medical treatment and services;
Terms of Use means this document titled 'Patient and Carer Terms of Use, Waiver and Release' and any attachments to this document and any Waiver;
Fly2 Foundation, we, us, or our refers to Fly2 Foundation and its officers, employees, agents, contractors, representatives, volunteers, assigns, and successors;
You or your refers to the Patient, the Patient's Carer, or any other person using the Services.
2. Acceptance
2.1 By signing these Terms of Use or accepting delivery of the Services, you agree to accept these Terms of Use and be bound by their provisions.
3. Booking of Services
3.1 Fly2 Foundation operates as a not-for-profit charity aimed at facilitating access to specialized medical services for vulnerable people. We do not operate as a commercial flying operation, the flights are conducted under community service flights.
3.2 We reserve the right to refuse Services to any person at any time in our absolute discretion, notwithstanding any earlier agreement.
3.3 While we Endeavor to arrange and provide Services on dates requested by your Referrer, we do not guarantee availability on the requested date.
3.4 You or the Referrer must promptly notify us of any changes to the Patient's request for Services.
3.5 We will confirm acceptance of your Flight Request Form in writing, including details of the Services, approximately 48 hours prior to the flight.
3.6 The Flight Request Form requires you (via the Referrer) to provide details of the number of Carers and Patients traveling, as well as their weights. Only approved Carers and weights will be permitted. Accurate passenger weights are essential and may be verified by us.
4. During the Services
4.1 We do not provide manual assistance to Patients. Carers must assist Patients in boarding and disembarking from the aircraft or vehicle.
4.2 Patients must be accompanied by an adult Carer (>18 years) for the entire duration of the Services.
4.3 It is crucial that you remain contactable by us during the provision of Services. You must provide us with your contact number(s) prior to accepting the Services.
4.4 You agree to comply with reasonable directions from us, including those from our pilots or drivers.
4.5 Appropriate clothing, including full covered footwear, must be worn during the Services.
4.6 Combined baggage weight for passengers is limited to 15 kilograms. Changes to baggage allowance must be approved by us prior to Services being provided.
